Welcome to Blinder, owned and operated by Manak Media LLC. By creating a Blinder account or using the Blinder app, you agree to be bound by these Terms of Use (the “Agreement”). If you do not accept and agree to these terms, please refrain from using our services.

1. Eligibility

  • You must be at least 18 years old to create an account or use Blinder.

  • By using Blinder, you represent and warrant that:

    • You can enter into a binding contract with us.

    • You are a resident of the United States, as Blinder is only available in the USA.

    • You will comply with this Agreement and all applicable local, state, and federal laws.

2. Account Responsibility

  • You are responsible for maintaining the confidentiality of your login credentials.

  • You are responsible for all activities that occur under your account.

  • If you suspect unauthorized access to your account, notify us immediately at creative@manakmedia.com.

3. User Conduct

When using Blinder, you agree to:

  • Use the service only for lawful purposes.

  • Respect other users and not engage in harmful, harassing, or discriminatory behavior.

  • Avoid sharing content that is obscene, offensive, defamatory, or violates any law.

  • Not use the app for commercial purposes, spam, or solicitation.

  • Not impersonate any person or entity or misrepresent your identity.

We reserve the right to investigate and terminate your account for any prohibited behavior, as detailed above, without notice.

4. Content on Blinder

  • Your Content: By posting content on Blinder, you grant us a non-exclusive, royalty-free, worldwide license to use, display, and modify your content as needed to provide the service.

  • Blinder’s Content: All intellectual property on the app, including logos, designs, and text, is owned by Manak Media LLC. You may not copy, distribute, or use it without our written permission.

  • Reporting Inappropriate Content: If you encounter content that violates these terms, you can report it through the app or email creative@manakmedia.com.

5. Privacy

Your privacy is important to us. Please review our Privacy Policy [link] to understand how we handle your personal data.

6. Subscription and Payments

  • Blinder may offer optional paid services (e.g., premium memberships).

  • All payments are final and non-refundable unless required by applicable law.

  • Subscriptions renew automatically unless canceled through your account settings.

7. Disclaimer of Liability

Blinder provides a platform for users to connect but does not guarantee specific outcomes (e.g., matches or relationships). We are not responsible for:

  • User behavior or actions taken by individuals you interact with on the app.

  • Any harm resulting from offline interactions initiated through the app.

Blinder is provided "as is" without warranties of any kind, express or implied. We disclaim any liability for loss or damage resulting from your use of the app.

8. Limitation of Liability

To the maximum extent permitted by law, Manak Media LLC and its affiliates are not liable for:

  • Indirect, incidental, or consequential damages arising from your use of Blinder.

  • Unauthorized access, data loss, or damage to your device caused by using Blinder.

9. Modifications to the Agreement

We may update these Terms of Use periodically to reflect changes in our services or legal obligations. The updated terms will be posted on the app, and your continued use of Blinder constitutes acceptance of the changes.

10. Termination

We reserve the right to terminate or suspend your account at our sole discretion for any reason, including breach of this Agreement. Upon termination, your right to access Blinder ceases immediately.

11. Governing Law

This Agreement is governed by the laws of the State of Tennessee and the United States, without regard to conflict of laws principles. Any disputes will be resolved exclusively in Knoxville, Tennessee.

12. Indemnification

You agree to indemnify and hold harmless Manak Media LLC, its affiliates, and employees from any claims, damages, or expenses arising out of your use of Blinder or violation of this Agreement.

13. Dispute Resolution and Arbitration

  • All disputes will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

  • By agreeing to arbitration, you waive your right to a trial by jury or participation in a class action lawsuit.

14. Miscellaneous

  • If any provision of this Agreement is found to be unenforceable, the remaining provisions will remain in effect.

  • Failure to enforce any right or provision does not constitute a waiver.

By using Blinder, you acknowledge that you have read and understood these Terms of Use and agree to be bound by them.
